E’ davvero possibile superare il concetto di forze dell’ordine?

Il caso di George Floyd non è isolato: la polizia di Minneapolis è nota per le numerose violenze compiute negli ultimi anni nella città che dovrebbe difendere, negli ultimi dieci anni il 60 per cento dei morti totali in scontri a fuoco con la polizia sono neri.  Negli Stati Uniti  d’America non sono mancati tentativi di riforma delle forze dell’ordine che  hanno  però incontrato una serie di ostacoli tali da non riuscire mai a  far concretizzare una riforma.   Dopo le manifestazioni succedute alla morte di George Floyd, è arrivata una proposta innovativa e provocatoria: smantellare il corpo di polizia nella città di Minneapolis e dirottare i fondi sulle politiche sociali.

L’annuncio è stato dato da 9 membri su 13 del consiglio comunale durante una delle ultime manifestazioni di protesta anche se il sindaco Jacob Frey si è detto contrario alla proposta, i numeri dei consiglieri a favore permetterebbero  però di superare il veto del sindaco Frey. I consiglieri vogliono dare vita al loro progetto di smantellamento del corpo di polizia agendo sul bilancio cittadino, il bilancio del 2020 è stato già modificato per via dell’emergenza sanitaria, ma si punta soprattutto a cambiare il bilancio del 2021.

Non son ancora noti i  dettagli  della proposta di riforma dei consiglieri comunali ma pare  si ipotizzi la possibilità di spostare i compiti della polizia locale su altri corpi o addirittura di riformare completamente la polizia nella città grazie ad un nuovo statuto.

Molti attivisti per i diritti degli afroamericani avevano già avanzato proposte qualche anno fa:  far supervisionare la polizia da civili, dare più spazio agli afroamericani nella polizia e, ancora, costringere gli agenti a indossare telecamere.

Ad oggi è difficile ipotizzare quali saranno le proposte salienti: smantellare completamente il corpo di polizia è difficile poiché  esso è previsto dallo statuto cittadino di Minneapolis e per modificare lo statuto potrebbe essere necessario un referendum cittadino. Al momento sono state disposte delle misure dal sindaco Frey per vietare alcune pratiche della polizia e per obbligare gli agenti ad intervenire  in caso di abuso della forza da parte di un collega.

L’idea di smantellare la polizia di Minneapolis ha fatto il giro del mondo: è davvero possibile vivere in una comunità di esseri umani senza la protezione di un corpo di polizia? Tutte le costituzioni occidentali nella tripartizione dei poteri hanno sempre previsto un corpo con  compiti di contrasto alla criminalità, al mantenimento dell’ordine pubblico e di pubblica sicurezza.

Si parla di scenari utopistici e difficili addirittura da immaginare nel mondo contemporaneo ai quali si accompagnano tanti interrogativi: in caso  necessità cosa succederà? E se l’ordine di una società dovesse venir meno?

Una riflessione  importante sullo “smantellamento” della polizia  può partire dal pensiero gandhiano riguardo la società nonviolenta e il concetto di polizia.

Gandhi ammette che anche in uno Stato non violento potrebbe essere necessaria una forza di polizia definendo questo passaggio come una imperfezione dell’Ahimsa (teoria della non violenza).

L’idea di polizia di Gandhi si preannunciava nell’Harijian diversa rispetto a quella del tempo: i ranghi dovevano essere composti da credenti nella non violenza che avrebbero dovuto servire il popolo e non esserne comandanti. Le persone, d’altro canto, avrebbero fornito aiuto attraverso la cooperazione reciproca evitando abusi di potere e rendendo anche il popolo partecipe alla cosa pubblica. Sulla detenzione di armi, il filosofo indiano  auspicava che la polizia possedesse delle armi  da usare raramente e solo in casi estremi.

Inoltre Gandhi si espresse sul binomio “crimine-criminale” sempre nell’Harijan definendo il crimine una malattia come qualsiasi altra, un prodotto del sistema sociale prevalente, dunque tutti i reati, incluso l’omicidio, sarebbero stati trattati come una malattia. A tal proposito parla di un’India non violenta con crimini ma senza criminali ed è proprio da quest’ultimo pensiero che nasce la necessità di riformare anche le carceri. Nessuno commetterebbe un reato per il gusto di farlo:  esso è il  segno di una mente malata. Le cause di una particolare malattia devono essere studiate e poi sradicate.

Per Gandhi nessun Paese può permettersi edifici “inutili” come le prigioni, tanto meno un Paese povero come era la sua India. Gli ospedali avrebbero curato la malattia del criminale grazie anche ad un personale dedicato alla cura della loro salute mentale ,evitando abusi.

Una teoria che può apparire  utopica ed inattuabile ma che  potrebbe essere un spunto interessante per affrontare  quanto avviene a Minneapolis: una società senza un “corpo di polizia” che faccia rispettare le leggi non è pensabile, potrebbe avere  però un senso  modellare  il corpo di polizia in modo  da valorizzare e rafforzare  la mission  sbilanciando gli interventi verso la tutela  della popolazione, della popolazione tutta, a garanzia dei  diritti, senza discriminazioni, scevra da abusi e corruzione.
